Rationes Decidendi:

A social insurance lawsuit is fi led on time if it is sent within the specified period to the court or the administrative authority whose decision is contested (Section 72(1) of the SŘS)6, but also it if is sent within the specified period to a corresponding authority or tribunal of another Member State of the EU. This conclusion is based on Article 86 of Council Regulation (EEC) 1408/717 on the application of social security schemes to employed persons, to self-employed persons and to their families moving within the Community [EU].
